On February 2, 2017 Governor Carney signed SB 13 into law which rewrote Delaware’s Abandoned or Unclaimed Property statutes.

Please see email from Secretary Bullock dated April 7, 2017 which provides guidance to Advocates and Holders in response to the new legislation.

SOS VDA Program Guidelines: The Department of State has published SOS VDA Program Guidelines. The SOS VDA Program Guidelines have been prepared to reflect the statutory change in reference to the SOS VDA Program from Section 1177 to 1173 and also references the SOS VDA Program Regulations.

Holder Handbook: The Department of Finance (“DOF”) has updated and published the Escheat Handbook (“Handbook”) as of February 2018. The Handbook provides Holders with instructions for preparing abandoned or unclaimed property reports and remittances.

NAUPA File: Holders are now able to create a NAUPA report without having to use a specialized software and can submit reports directly via the DOF website. This option is only available to Holders who are reporting a limited number of line items on their annual report or SOS VDA submission. This information will need to be manually entered by the Holder.
